End-User License Agreement (EULA)

This End-User License Agreement ("EULA") governs your use of the Drip Meter mobile app and any updates to it (the "App"). This EULA is between you and Drip Meter only — not with Apple or Google. The App store through which you obtained the App (Apple's App Store or Google Play) is not responsible for the App or its content.

On Apple's App Store, this EULA is the license agreement for the App in place of Apple's standard Licensed Application End User License Agreement, and it includes the minimum terms Apple requires (section 9). For a copy obtained through Google Play, Google Play's terms of service also apply, and where they conflict with this EULA they take precedence to the extent of the conflict. Nothing in this EULA overrides the usage rules of the Apple Media Services Terms and Conditions or the Google Play Terms of Service, and nothing in it limits any consumer right you cannot waive.

1. License grant

We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable license to download and use the App on devices you own or control: for the App Store, any Apple-branded device, and for Google Play, any Android device — in each case as permitted by the usage rules of the applicable app store. This is a license, not a sale; we and our licensors retain all rights not expressly granted.

2. Restrictions

You may not: (a) copy, modify, or create derivative works of the App except as the App's normal operation allows; (b) reverse-engineer, decompile, or disassemble the App, except to the extent applicable law expressly permits despite this restriction; (c) rent, lease, lend, sell, redistribute, or sublicense the App; (d) remove or alter any proprietary notices; or (e) circumvent the trial, the free-tier limit, or any entitlement check.

3. In-app purchase and entitlement

The App offers a single one-time, non-consumable in-app purchase ("Pro") that removes the free-tier limit for your store account. Pro is not a subscription and does not auto-renew. Your entitlement is determined by your store account's purchase records, read through the platform; we store no separate entitlement record. On platforms that share in-app purchases through Family Sharing — currently Apple's App Store — eligible members of your family group may use Pro via the platform's Restore-purchase mechanism without a separate purchase. Google Play does not offer this for in-app purchases, so on Android a family member must buy Pro separately. Pro is tied to the store account of purchase and does not transfer across platforms.

4. Refunds

All purchases are made through Apple or Google; Drip Meter does not process payments and never sees your payment details. Apple decides and issues App Store refunds under its own policy; on Google Play, refunds go through Google within the store's refund window and after that through us at support@dripmeter.me, issued using Google Play's tools, without affecting your statutory rights. A refund processed by the store removes Pro access the next time you fully close and reopen the App after the refund reaches your store account's purchase records. Nothing in this section affects your statutory rights.

5. Your content and data

You retain all rights to the data you enter. The App stores your data on your device and, if you enable backup, in your own cloud account; Drip Meter does not receive or store it. You are responsible for safeguarding your device, your store account, and your cloud credentials, and for any data loss arising from their compromise or from deletion of a backup. Handling of operational data is described in the Privacy Policy.

6. Updates

We may provide updates to the App. This EULA governs any updates unless an update is accompanied by a separate license, in which case that license governs.

7. Termination

This EULA applies for as long as you use the App. You can end it at any time by deleting the App. We may end it if you materially breach it (for example, section 2) and, where the breach can be fixed, you do not fix it within a reasonable time after we notify you. When this EULA ends you must stop using the App and delete your copies. Ending this EULA does not take away consumer rights you already have in connection with a Pro purchase, including any statutory refund remedies; and if it ends for a reason other than your material breach, we will not treat your paid Pro unlock as forfeited. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and governing law) survive.

8. Disclaimers and limitation of liability

To the maximum extent permitted by law, the App is provided "as is" without warranty of any kind, and Drip Meter's liability is limited as set out in the Terms of Service. If you are a consumer, nothing in this EULA affects your legal rights — including the legal guarantee that digital content conforms to the contract — or excludes liability that cannot lawfully be excluded, such as liability for death or personal injury caused by negligence, fraud, or willful misconduct or gross negligence. Sections 8 and 9 of the Terms of Service (including their consumer carve-outs) apply to this EULA as if set out here.

9. App Store / Play Store required terms

The following apply to the extent your copy of the App was obtained through the relevant store:

  • Acknowledgement. This EULA is between you and Drip Meter only, not with Apple or Google. Drip Meter, not the store, is solely responsible for the App and its content.
  • Who we are. The App is licensed to you by [PLACEHOLDER: legal entity], [PLACEHOLDER: postal address]. Questions, complaints, or claims: support@dripmeter.me, [PLACEHOLDER: telephone number].
  • Scope of license. The license is limited to a non-transferable license to use the App on devices you own or control — any Apple-branded device for the App Store, and any Android device for Google Play — per the store's usage rules, except that the App may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing, where the store offers it.
  • Maintenance and support. Drip Meter is solely responsible for any maintenance and support; the stores have no obligation to provide it. Support: support@dripmeter.me.
  • Warranty. Drip Meter is solely responsible for any product warranties, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty on the App Store, you may notify Apple for a refund of the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation for the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Drip Meter's sole responsibility.
  • Product claims. Drip Meter, not the store, is responsible for addressing any claims relating to the App (including product-liability, legal-or-regulatory-noncompliance, consumer-protection, and privacy claims), as between Drip Meter and the store.
  • Intellectual-property claims. Drip Meter, not the store, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual-property infringement claim concerning the App.
  • Third-party beneficiary. For a copy of the App obtained through Apple's App Store, Apple and its subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of this EULA, Apple will have the right (and is deemed to have accepted the right) to enforce it against you as a third-party beneficiary. Google is not a party to this EULA; your download and purchases through Google Play are also governed by Google Play's own terms.
  • Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. You will comply with applicable third-party terms of agreement when using the App.

10. Governing law

This EULA is governed by Spanish law. If you are a consumer, you keep the protection of any mandatory consumer rules of the country where you usually live, and disputes may be brought before the courts described in section 11 of the Terms of Service.
